Moyers & Company: And Justice for Some (Enhanced DVD) Half a century since a landmark legal petition created defendants' right to a public attorney, the legal system still faces an uphill battle against discrimination. Civil rights attorney Bryan Stevenson reveals the underlying current of racial and class prejudice that continues to unbalance the scales of justice.

Stevenson's insight provides a multitude of reasons why the justice system continues to be unfair. From prison overcrowding due to the costly War on Drugs to lack of proper lawyer education, those hit hardest by injustice tend to be the poor and minority groups. Courts are accused of tolerating ineffective counselors that work for defendants who can't afford to pay. The problem is so severe that a quarter of death penalty cases are revealed to have been counseled by poor lawyers who were later disbarred. And this is only one of many shocking facts revealed in this episode of Moyers & Company.

Throughout this fascinating installment we discover how factors such as where you live or the color of your skin impact your likelihood of receiving poor counseling in court. We also learn how the system can be improved, with the right support and resources.

Over 50 years ago, a landmark Supreme Court decision gave criminals the right to a legal defense, even if they could not afford it. While this gave many criminals a new right in the justice system, the legal system still favored the wealthy and white. Those who are wealthy are all too often able to avoid the full wrath of the law by hiring skilled attorneys who are able to adequately research their cases and defend them to the fullest extent, while court appointed attorneys hardly have time for plea bargaining. In this edition of Moyers and Company, Bill meets with legal scholar and civil rights attorney Bryan Stevenson. He exposes the shortcomings of the legal system and its constant struggles with class, justice, and race.

The various failures of the criminal justice system are highlighted in the program. Journalists Tim O’Brien and Martin Clancy talk about the problems with death row legal representation and sentencing throughout the United States. An essay on the hypocrisy “justice for all” is used to close out the program, in a nation where billions are wasted in a war born in fraud while those who have the lowest incomes are neglected and brushed aside.
